Who we are and what this policy covers
Evolve Lending and Finance is the trading name of 123 Fin Pty Ltd ACN 169 948 716 as trustee for the 123 Fin Unit Trust, Credit Representative 467089 of Beagle Finance Pty Ltd, Australian Credit Licence 383640. We arrange home loans, commercial finance, asset and equipment finance and specialist lending for individuals, businesses and self-managed super funds.
This policy explains what personal information we collect, why, who we share it with and how you can access or correct it. We handle personal information under the Privacy Act 1988 (Cth), the Australian Privacy Principles and, for credit information, Part IIIA of the Privacy Act and the Privacy (Credit Reporting) Code. Our licensee’s privacy policy and credit reporting policy also apply to the information we handle on its behalf.
When you apply for finance through us you will also receive a privacy consent and collection notice. That document is specific to your application and sits alongside this policy.
What we collect
The information we collect depends on what you ask us to do. For a finance application it is usually most of the following:
- Identity and contact details: name, date of birth, address, phone, email, and identity documents such as a driver licence, passport or Medicare card, which lenders require us to verify.
- Financial information: income, employment, assets, liabilities, expenses, bank statements, tax returns, business financials, superannuation details and the purpose of the finance.
- Credit information: your credit report and credit score, repayment history, defaults and other information from credit reporting bodies, and information about your existing loans.
- Information about other people: details of a spouse, guarantor, director, trustee or beneficiary where they are part of the application. If you give us someone else’s information, please make sure they know you have done so and have seen this policy.
- Sensitive information, only where it is relevant and with your consent: for example health information if you are applying for a hardship arrangement or medical finance, or membership of a professional association where a lender offers a benefit for it.
- Business contacts: if you are a referral partner, lender contact or supplier, your name, role and contact details.
- Website and marketing data: how you use our website and emails, as described under Website, cookies and tracking below.
We do not collect tax file numbers unless a specific lender form requires it, and we remove them from documents we receive where they are not needed.
You can deal with us anonymously for general enquiries, but we cannot assess or arrange finance without identifying you.
How we collect it
Most information comes from you: in conversations, meetings and video calls, through our forms and online enquiry, by email, and through the documents you give us. We also collect information from others where the application needs it:
- credit reporting bodies, with your consent, when we obtain your credit report;
- lenders and mortgage insurers about your existing or proposed loans;
- your accountant, financial planner, solicitor, real estate agent or other adviser who referred you or is working on the same transaction, with your authority;
- your employer, to verify employment, where you have authorised it;
- valuers, settlement agents and identity verification services; and
- public sources such as ASIC, the Australian Business Register and property title searches.
If you contact us we may keep a record of that contact, and calls and video meetings may be recorded or transcribed as described under Artificial intelligence below.
Why we use it
We use personal information for the purpose you gave it to us: to understand your situation, assess what finance is possible, recommend a lender and structure, prepare and lodge your application, and manage the loan through to settlement and beyond. Specifically, that includes:
- verifying your identity and meeting our obligations under the National Consumer Credit Protection Act, including responsible lending and the best interests duty;
- assessing serviceability and suitability and comparing lender products;
- communicating with lenders, valuers, insurers and solicitors on your behalf;
- keeping you informed about your application and your loan, including fixed-rate expiries and review opportunities;
- handling complaints, disputes and hardship requests;
- meeting our record-keeping, audit and compliance obligations to our licensee, our aggregator and regulators;
- managing our business, including invoicing, insurance and professional advice; and
- recruitment and the employment of our people.
We also use contact details to send you information we think is useful, which you can stop at any time; see Marketing below.
If you choose not to give us information we ask for, we may not be able to arrange finance for you or may be limited in what we can do.
Who we share it with
Arranging finance means your information moves between the parties to the transaction. We share it only as far as that purpose, your consent or the law requires, with:
- our licensee and aggregator, Beagle Finance Pty Ltd trading as Finsure, which holds our records on its lodgement platform, supervises our compliance and handles escalated complaints;
- lenders and lenders mortgage insurers you apply to or that we are comparing on your behalf, and their valuers, settlement agents and solicitors;
- credit reporting bodies, when we obtain your credit report with your consent (see Credit information below);
- your other advisers, such as your accountant, financial planner, solicitor, conveyancer or real estate agent, where you have asked us to work with them or they referred you to us, and only to the extent the transaction needs;
- guarantors and co-borrowers, to the extent needed to progress a joint application;
- service providers who support our business under confidentiality obligations: our customer relationship management system, Microsoft 365, document storage, e-signature, identity verification, phone and video platforms, AI tools (see Artificial intelligence below), IT support, bookkeeping, insurers and professional advisers;
- regulators, external dispute resolution and the law: ASIC, the Office of the Australian Information Commissioner, the Australian Financial Complaints Authority, courts and law enforcement where required or authorised by law; and
- a purchaser of our business, if the business or part of it is sold, on terms that keep this policy in place.
We do not sell personal information, and we do not give client information to referral partners for their own marketing.
Credit information
When you apply for finance we may, with your consent, obtain your credit report from a credit reporting body such as Equifax, Experian or illion, and share it with the lenders we are considering. We use credit information only to assess your application and recommend suitable lenders. We do not disclose credit information to anyone else, and we do not use it for marketing.
Credit reporting bodies may use your credit information to assist other credit providers to assess your creditworthiness. You can ask a credit reporting body not to use your credit information for pre-screening direct marketing by credit providers, and to put a ban on your file if you believe you have been or may be a victim of fraud. Their privacy policies, and our licensee’s credit reporting policy, explain how to do this and how to seek access to or correction of your credit information.
If you want your credit report corrected, tell us and we will work with the lender or credit reporting body on your behalf, or you can contact them directly.
Overseas disclosure
We do not send your information to lenders or advisers outside Australia. Some of our service providers store or process data on servers outside Australia, including cloud, email, document and AI platforms whose infrastructure may be located in the United States, the European Union or Singapore. Where that happens we take reasonable steps, including contractual protections, to ensure the provider handles your information in a way consistent with the Australian Privacy Principles.
Artificial intelligence
We use artificial intelligence (AI) tools to help us work efficiently. This includes tools that summarise documents, draft correspondence and lender submissions, transcribe and summarise calls and meetings, and help us research lender policy and market information. Some of these tools are provided by third-party technology vendors.
When we use AI tools with your personal information, we do so only for the purposes for which we collected it: assessing, arranging and managing your finance, and providing you with our services. We use enterprise-grade tools under agreements that prevent the vendor from using your information to train their AI models, and we do not enter your personal information into publicly available AI tools. Where an AI tool is operated by a third party, your information may be processed by that vendor on our behalf, including on servers located outside Australia, as described under Overseas disclosure.
We do not use your sensitive information in AI tools without your consent, and we do not use AI to generate or infer information about you that you have not provided to us.
AI tools assist our staff; they do not make decisions about you. Every assessment, recommendation and lender submission is prepared and verified by a qualified broker who is responsible for its accuracy and can explain how it was reached. Where AI has contributed to a document on your file, we record that it was AI-assisted and who verified it.
If we record or transcribe a call or meeting using an AI tool, we will tell you at the start and you can ask us not to. Transcripts are kept with your file and deleted in line with our retention practices.
If you interact with an AI tool on our website or through our communications, we will clearly identify it as AI. You can ask to deal with a person at any time.
Marketing and how to opt out
If you are a client or have enquired with us, we may send you information about lending, property and business finance, rate and policy changes that may affect you, and events we run, by email, SMS, phone or post. We do not send marketing to people who have not dealt with us, and we do not use credit information for marketing.
You can opt out at any time by using the unsubscribe link in any email, replying STOP to an SMS, or emailing [email protected]. We action opt-outs within five business days. Opting out of marketing does not stop us contacting you about your application or loan.
Website, cookies and tracking
Our website uses cookies and similar technologies to make the site work, understand how it is used and measure our advertising. This includes analytics (such as Google Analytics) and advertising pixels (such as the Meta pixel and Google Ads tag) that record pages visited and enquiries made so we can measure campaigns and show relevant content to people who have visited our site. These tools may collect your IP address, device identifiers and browsing behaviour and share them with the platform operator under that operator’s privacy policy.
You can control cookies through your browser settings and opt out of personalised advertising through the Meta and Google ad settings. Blocking cookies may affect how parts of our website work. Our website links to third-party sites and embedded content whose privacy practices we do not control; a link is not an endorsement.
If you complete an enquiry form, calculator or booking on our website, the information you enter is collected under this policy and used to respond to you.
How we keep it secure and how long we keep it
Your information is held in our customer relationship management system, our licensee’s lodgement platform and our Microsoft 365 environment, all protected by access controls, multi-factor authentication and encryption. Paper documents are scanned to your file and destroyed. Our staff are trained in privacy and information security and are bound by confidentiality obligations.
We keep client files for seven years after your loan settles or your file is closed, as our licensee and credit laws require, and then securely destroy or de-identify them. Enquiries that do not proceed are kept for the same period unless you ask us to delete them earlier and no legal reason requires us to keep them.
Data breaches
If we believe your personal information has been lost or accessed or disclosed without authorisation, and that this is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme, and tell you what we are doing about it and what you can do.
Access and correction
You can ask to see the personal information we hold about you, or ask us to correct it, by contacting our Privacy Officer using the details below. We will verify your identity first, and respond within 30 days. There is no charge for a request, though we may charge a reasonable fee for copying a large file. In limited cases the law allows us to refuse access, for example where it would unreasonably affect another person’s privacy; if that happens we will tell you why.
If we do not agree that information is inaccurate, you can ask us to attach a statement to the record noting that you believe it is wrong.
You can also ask us to delete your information. We will do so unless we are required to keep it by law, by our licensee’s record-keeping obligations or to manage a legal or compliance risk, in which case we will tell you.
Complaints
If you have a concern about how we have handled your personal information, contact our Privacy Officer. We will acknowledge your complaint within one business day, investigate it, and give you a written response within 30 days. If you are not satisfied, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or 1300 363 992. For complaints about credit information or our credit services you can also contact the Australian Financial Complaints Authority at afca.org.au or 1800 931 678, which is free.
Changes to this policy
We review this policy at least annually and whenever our systems, tools or legal obligations change. The current version is always at evolvelending.com.au/privacy-policy, and the date at the top tells you when it was last updated.
